Check-in and check-out regulation

1. the customer does not acquire any claim to the provision of specific rooms, unless this claim is explicitly mentioned in the booking confirmation.

2. booked rooms are available to the customer from 16:00 on the agreed day of arrival. The customer is not entitled to earlier availability.

3. on the agreed day of departure, the rooms must be vacated and made available to the Hotel Feldberger Hof Banhardt GmbH by 10:00 a.m. at the latest. After this time, the Hotel Feldberger Hof Banhardt GmbH may charge 50% of the normal room rental price for that day for the additional use of the room until 3.00 p.m., and 100% for use after 3.00 p.m., in addition to any damages incurred. The customer is at liberty to prove to the Hotel Feldberger Hof Banhardt GmbH that no or significantly less damage has been incurred.

4. if the room key is lost, a fee of €50 per lost key will be charged.

Differing cancellation conditions

1. cancellation by the customer of the contract concluded with the Hotel Feldberger Hof Banhardt GmbH requires the written consent of the Hotel Feldberger Hof Banhardt GmbH. If this is not done, the agreed price from the contract must be paid even if the customer does not utilise contractual services. This does not apply in cases of delayed performance on the part of the Hotel Feldberger Hof Banhardt GmbH or in the event of impossibility of performance for which the Hotel Feldberger Hof Banhardt GmbH is responsible.

2. the customer has the right to withdraw from the contract concluded with the hotel up to 28 days (11:59 p.m.) before the day of arrival without incurring payment or compensation claims by the hotel. The prerequisite for this is that the cancellation notice is received by the hotel in text form by the 28th day before the day of arrival.

3. cancellation less than 28 days before arrival will result in a cancellation fee: The Hotel Feldberger Hof Banhardt GmbH is free to charge a lump sum for the damage incurred and to be compensated by the customer. The lump sum is 80 % of the total booking price. The customer is free to prove that no damage has been incurred or that the damage incurred by the Hotel Feldberger Hof Banhardt is lower than the lump sum demanded.

4. should the Hotel Feldberger Hof be fully booked on individual days during the stay cancelled by the customer, the pro rata travel price attributable to the booked-out days shall not be charged to the customer and shall be deducted from the aforementioned flat rate. The prerequisite is that all rooms in the booked room category are fully booked.

5. if the customer is unable to start the booked trip due to a general travel restriction imposed by the authorities (e.g. in the event of a border closure), the customer may cancel free of charge up to the day of arrival against proof of the travel restriction.

Important payment information and other conditions

The hotel stay is to be paid on the day of departure in cash, with EC-Cash or the credit cards Mastercard or Visa.

During peak seasons such as Christmas/New Year's Eve and Carnival, a deposit is required at the time of booking.

1. the Hotel Feldberger Hof Banhardt GmbH is obliged to provide the rooms booked by the customer and to provide the agreed service. The agreed service is based exclusively on the service confirmed by the hotel in the booking confirmation.

2. in order to guarantee compliance with the general preventive measures required by the authorities, the contractually agreed services may be unilaterally changed by the hotel at any time. These include, in particular, regulations on the wearing of protective clothing in public areas, changes to the food and beverage offer, changes to meal times, changes and, if necessary, cancellation of the range of services and restrictions on the use of the hotel infrastructure. Upon request, the Hotel Feldberger Hof Banhardt GmbH must prove to the customer that the unilateral changes to the contractually agreed services are necessary in order to guarantee compliance with the general preventive measures required by the authorities. Unilateral changes to the agreed services by the hotel have no influence on the price agreed in the booking confirmation.

3. the customer agrees to observe appropriate usage regulations and restrictions on hotel services and to inform the Hotel Feldberger Hof Banhardt GmbH immediately in the event of symptoms of illness.

4. the customer is obliged to pay the applicable or agreed prices of the Hotel Feldberger Hof Banhardt GmbH for the room rental and the other services used by him. This also applies to services and expenses of the Hotel Feldberger Hof Banhardt GmbH to third parties arranged by the customer.

5. the prices agreed with the booking confirmation include the statutory value added tax applicable at the time of booking. Should the statutory VAT be increased between the time of booking and the start of the trip, the price of the trip will be increased accordingly. If the statutory VAT is reduced between the time of booking and the start of the holiday, the price of the holiday will not be reduced.

6. if the period between conclusion and fulfilment of the contract exceeds 4 months and the price generally charged by Hotel Feldberger Hof Banhardt GmbH for such services increases, the latter may increase the contractually agreed price appropriately, but by no more than 10%, provided that the price increase is based on the fact that the maintenance costs necessary for the operation of the hotel have increased in the last 4 months after the booking. The increase may only be made to the same percentage extent as the increase in the maintenance costs required to operate the hotel.

7. the contractually agreed prices may also be changed by the Hotel Feldberger Hof Banhardt GmbH if the customer subsequently requests changes to the number of rooms booked, the services of the Hotel Feldberger Hof Banhardt GmbH, the number and age of the travellers or the length of stay of the guests and the Hotel Feldberger Hof Banhardt GmbH agrees.

8. a visitor's tax must be paid for the stay, which is levied by the municipality of Feldberg per night and per adult guest or per child aged 6 to 15 years. Irrespective of the information in the booking confirmation, the visitor's tax may change in accordance with the municipality's regulations and must be paid by the guest at the applicable rate.

9. invoices of the Hotel Feldberger Hof Banhardt GmbH are generally due upon receipt of the invoice without deduction. The Hotel Feldberger Hof Banhardt GmbH is entitled to declare accrued claims due at any time and to demand immediate payment. In the event of late payment, the Hotel Feldberger Hof Banhardt GmbH is entitled to charge interest on arrears in accordance with 288 BGB.

10. the hotel is entitled to demand an appropriate advance payment or security deposit upon conclusion of the contract or thereafter, taking into account the legal provisions for offers. The amount of the advance payment and the payment dates may be agreed in writing in the contract.

11. the customer may only offset or reduce a claim of the hotel with an undisputed or legally binding claim.

12. we charge a fee of 25 euros for the first rebooking after the booking has been legally confirmed. A fee of 50 euros will be charged for each subsequent rebooking. Every rebooking requires the consent of Hotel Feldberger Hof Banhardt GmbH.
